General terms and conditions of sale of Spirit 75

Article 1. Object

These terms and conditions of sale are entered into by the company Spirit 75, whose head office is located at 67 rue Saint Jacques 75005, Paris, registered with the Paris Trade and Companies Registry under number 927 785 337 R.C.S. Paris, and whose Intracommunity VAT number is FR96927785337, hereinafter referred to as “Spirit 75”, and managing the “Spirit 75” website https://www.spirit75.com and, secondly, by any individual or legal entity wishing to make a purchase via the “Spirit 75” website https://www.spirit75.com, hereinafter referred to as the “buyer”.

The present conditions of sale aim to define the contractual relationship between “Spirit 75” and the buyer, and the conditions applicable to all purchases made through the “Spirit 75” website https://www.spirit75.com The acquisition of a product through the present site implies unreserved acceptance by the buyer of the present conditions of sale, which the buyer acknowledges having read prior to ordering. Prior to any transaction, the buyer declares on the one hand that the purchase of products on the “Spirit 75” website https://www.spirit75.com is not directly related to his or her professional activity and is limited to strictly personal use, and on the other hand that he or she has full legal capacity, enabling him or her to commit to these general terms and conditions of sale.

Spirit 75″ reserves the right to modify these conditions of sale at any time, in order to comply with new regulations or to improve the use of its site. As a result, the applicable conditions will be those in force at the date of the buyer’s order.

Article 2. Products

The products offered are those shown on the “Spirit 75” website https://www.spirit75.com, from the “Spirit 75″ company, while stocks last. Spirit 75” reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics. Photographs are as accurate as possible but are not binding on the Seller. The sale of products presented on the https://www.spirit75.com website is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

(1) The store is available on the Spirit 75 platform. The boutique is created and operated by Spirit 75.

(2) Spirit 75 is responsible for the articles and motifs offered in a “Spirit 75 store” and for the arrangement of the store as a whole.

(3) The online merchant is solely responsible for the items and motifs offered in his store and for the store layout and promotion of the items offered.

(4) Spirit 75 reserves the right to withdraw a product that is no longer available in the catalog. And at any time of the year.

Article 2b. Technical and design differences

In the performance of the contract, we expressly reserve the right to deviate from the descriptions and indications in our brochures, catalogs and other written and electronic documents with regard to the type of fabric, color, weight, size, design or similar characteristics, insofar as these are acceptable to the purchaser. Reasons for modification may arise from commercial fluctuations and technical production rhythms.

Article 3. Rates

The prices appearing on the product sheets of the internet catalog are in Euros (€), all taxes included (TTC), taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The company “Spirit 75” reserves the right to modify its prices at any time, it being understood however that the price appearing in the catalog on the day of the order will be the only one applicable to the purchaser. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order. In metropolitan France, for all orders equal to or greater than 100 euros, shipping is free; for all orders less than 100 euros, a flat-rate contribution to shipping costs will be invoiced to the buyer according to the product order details, weight and distance.

Article 4. Ordering and payment

Before placing an order, the buyer must create an account on the “Spirit 75” website, https://www.spirit75.com. The account creation section can be accessed directly from the top menu bar. Each time you visit the site, if you wish to place an order or consult your account (order status, profile, etc.), you must identify yourself using this information. The company “Spirit 75”, offers the buyer to order and pay for products in several stages, with 3 payment options to choose from:

Secure payment by credit card (via PAYPAL, APPLE PAY, GOOGLE PAY, WOOCOMMERCE PAYMENT or STRIPE): the buyer selects the products he/she wishes to order in the “basket”, modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of his choice: “Payment by credit card”. The next step is to check all the information, read and accept the present terms and conditions of sale by ticking the appropriate box, and then confirm the order by clicking on the “Confirm my order” button. Finally, the buyer is redirected to the secure interface of the payment systems, where he or she can safely enter his or her account or credit card details. If payment is accepted, the order is recorded and the contract is definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the purchaser may demand cancellation of the card payment, in which case the sums paid will be credited back or refunded. The cardholder is not liable if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement for the fraudulent debit and any bank charges that may have been incurred, the cardholder must contest the debit in writing to his or her bank within 70 days of the transaction, or 120 days if provided for in the contract. The amounts deducted are reimbursed by the bank within a maximum of one month of receipt of the cardholder’s written objection. No costs will be charged to the holder for the return of the sums.

Payment by bank transfer: the buyer selects the products he/she wishes to order in the “basket”, modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of his choice: “Payment by bank transfer”. In the last step, the customer is asked to check all the information, to read and accept the present terms and conditions of sale by ticking the appropriate box, and then to confirm the order by clicking on the “Confirm my order” button. This last click constitutes the final conclusion of the contract. Upon validation, the buyer receives a purchase order confirming the registration of his order. In order to finalize payment and process the order, the buyer must contact his bank to transfer the amount of his order to the bank account of the company “Spirit 75”, whose details are communicated to the buyer. As soon as the transfer is received, the order will be processed and the buyer will be informed by e-mail. The company “Spirit 75” will ship the products at the earliest 2 working days after receipt of the transfer corresponding to the order, subject to provisions.

Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement of full knowledge of them and waiver of the right to invoke one’s own terms and conditions of purchase. All the data provided and the recorded confirmation will constitute proof of the transaction. If the purchaser has an e-mail address and has entered it on the order form, “Spirit 75” will send confirmation of the order by e-mail.

Article 5. Reservation of ownership

The company “Spirit 75” retains full ownership of the products sold until full payment has been received, in principal, costs and taxes included.

Article 6. Withdrawal

In accordance with article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from delivery of their order to exercise their right of retraction and return the product within a maximum of thirty days to the seller for exchange or reimbursement without penalty, with the exception of the cost of return.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are processed by La Poste, or any other delivery service such as Colissimo, Chronospost, DPD, Mondial Relay, Relais Colis, DHL, FedEx, UPS. Delivery times are given as an indication only; if they exceed 30 days in Europe (excluding deliveries from the USA/Asia), i.e. 60 to 90 days, from the date of order, the sales contract may be cancelled and the purchaser reimbursed. The company “Spirit 75” may provide the buyer with the tracking number of his parcel by e-mail. The buyer is delivered to his home by his letter carrier or any other type of deliveryman. If the purchaser is absent, he/she will receive a notice from the postman/deliveryman, allowing him/her to collect the products ordered from the nearest post office or parcel relay, during a period indicated by the postal services or delivery service. The risks associated with transport are borne by the purchaser from the moment the items leave the premises of the company “Spirit 75”. The buyer is obliged to check the condition of the packaging and the contents of the goods on delivery, in the presence of the employee of La Poste or the delivery person. In the event of damage in transit, any protest must be made to the carrier within three days of delivery.

Article 8. Warranty

All products supplied by the “Spirit 75” company are covered by the legal warranty provided by articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned to the company “Spirit 75”, according to the return addresses provided in the FAQ. All claims, requests for exchange or refund must be made by post to Printful’s address, as indicated in the FAQ, and within thirty days of delivery.

Article 9. Liability

The company “Spirit 75”, in the process of distance selling, is only bound by an obligation of means. It cannot be held liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, disruption of service, or other involuntary problems.

Article 10. Intellectual property

All elements of the Spirit 75 site are and remain the exclusive intellectual property of the “Spirit 75” company, whose trade name is “Spirit 75”. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photo, logo, visual or text. In addition, the “Spirit 75” brand name has been registered with INPI. Any reproduction, in whole or in part, of the Spirit 75 website, its motifs, logos, photographs and drawings, will be liable to prosecution.

Article 11. Personal data

The company “Spirit 75” undertakes to preserve the confidentiality of information provided by the purchaser, which he/she may be required to transmit in order to use certain services. Any information concerning him/her is subject to the provisions of law no. 78-17 of January 6, 1978. To this end, users have the right to access, modify and delete information concerning them. He may request this at any time by post to the following address: “Spirit 75”, 67 rue Saint Jacques, 75005, Paris.

Data protection

Spirit75 processes individual customer data according to established criteria and in compliance with legal provisions and following the RGPD rule. The personal data provided when ordering goods (such as name, e-mail address, postal address, payment details) are used by Spirit75 to fulfill the contract. These data are treated confidentially by Spirit75 and are not communicated to third parties involved in the order, delivery and payment process. The customer has the right, on request, to receive information free of charge about the individual data Spirit75 has stored about him or her. In addition, he/she has the right to rectify inaccurate data, and to delete and erase his/her personal data, provided there is no legal obligation to do so.

Article 12. Dispute resolution These conditions of distance selling are governed by French law. For all disputes or litigation, the competent court will be that of Paris.
